Jiah Khan case: Prosecution accuses Sooraj Pancholi of murder and rape

In a new turn of events, the prosecution for actress Jiah Khan sought to invoke a charge of murder against actor Sooraj Pancholi, who has till now been accused of abetting the suicide.

“Rabiya (Jiah’s mother) is the informant and she says it’s the case of section 302 of IPC (murder). She was the first one who saw the body hence Sooraj should be charged for murder,” Public Prosecutor Kalpana Hire told the special women’s court conducting the trial in the case, reported NDTV.

Ms Hire also told the court that charges of rape and causing miscarriage without woman’s consent should also be formed against the accused. However, the trial court will decide on the murder charge on May 20.

Sooraj Pancholi’s lawyer, Prashant Patil retaliated saying that there was no evidence to form a murder charge against the actor. “The foetus was three to four weeks old and cannot be forcefully pulled out, as it was larger larger than 0.5 cm to 0.13 cm,” Time of India quotes the lawyer. He also said that the termination was a medical one and no evidence of her going to doctors has been presented.

Sooraj was arrested on June 10, 2013 but released on July 2, 2013 after the HC granted him bail. The petition alleged that the CBI concluded in haste that the case was that of suicide; that it did not bother to counter question concerned people and that it did not bother getting important evidence on record.
