Mumbai: A Mumbai sessions court has convicted and sentenced 11 women and one man to two years in prison for assaulting, stripping and parading a 22-year-old girl naked in Sewri in 2010.
The court also said that the defence’s plea that women cannot be charged under Section 354 for “outraging the modesty of women” did not hold water, according to a report in a leading English daily.
The court observed that according to Section 8 of IPC that deals with gender, the pronoun ‘he’ and its derivatives can be used for any person, whether male or female. “The ‘He’ used in Section 354 (outraging the modesty of a woman) of IPC requires to be read as per definition of gender under Section 8 of IPC which applies to the male or female. So in such a situation, Section 354 of IPC would apply to women also,” the court said.
On June 17, 2010, the victim was stripped and lashed in Sewri, after her brother had been arrested for raping a minor the day before.
The accused include Mumtaz Shaikh (35), Shabina Sahaikh (37), Rehana Shaikh (32), Kamrunissa Khan (40), Malati Bhagat (50), Rabiya Koyari (33), Lalmuni Baretha (50), Anita Waghela (30), Kalpana Koyari (45), Damodar Mule (42), Sharda Yadav (41) and Sunita Mishra (40) and were also fined Rs 1,000 each.
