A petition has been filed against the derogatory, sexist, outrageous and illegal remarks made by BJP leader Shri Subramaniam Swamy against Married Women in general and India’s tennis star Sania Mirza in particular.
This petition is to draw the attention of the National Commission for Women (NCW) towards the derogatory, sexist, offensive and illegal remarks made by BJP leader Shri Subramaniam Swamy against Married Women in general and India’s tennis star Sania Mirza in particular .
The facts are as follows:
On 24th July 2014,
1) Shri Subramaniam Swamy made the following derogatory & offensive remarks:
“I agree with the BJP leaders that when people have divided loyalties, we cannot expect them to represent the country or any part of the country faithfully. So, the BJP stand is well taken.”

2) The above remark made by Shri Swamy are tantamount to suggesting that merely by marriage a woman’s loyalties gets divided and she becomes an anti-national! This is a completely derogatory and hypocritical stand taken by him as he does not set the same standard for married men. Moreover, Mr.Swamy, one of the tallest leaders of the BJP- a national political party , affirms that this is the BJP stand. Indeed, the entire controversy surrounding Sania Mirza had erupted when the Telangana unit of BJP stated that Sania Mirza, an Indian tennis legend and a role model for all Indians is the daughter-in-law of Pakistan. 3) These remarks are not only deeply patriarchal, sexist, immoral, unethical, insensitive and bordering on sheer lunacy but also illegal and constitute the violation of various provisions of the law including the Indecent Representation of Women (Prohibition) Act and section 153A & 505(2) of the Indian Penal code in as much as they falsely and unjustifiably stereotype married women and cause hatred and incitement.
4) The BJP is a national political party registered with the Election Commission of India under the Representation of People’s Act. These statements made by Shri Swamy and the Telangana unit of the BJP are also in violation of the spirit of the Constitutional provisions that guarantee right to equality and equal protection to women under Article 14 and dignity to women under Article 21.
In light of these above facts it is most humbly prayed that :
a) The NCW must immediately take up this matter and move the court/ police for registration of a complaint against Shri Subramanian Swamy under relevant sections of the law for making such derogatory and false statements.
b) The NCW must issue show cause to the Bharatiya Janta Party to clarify its stand on the statements of Shri Subramanian Swamy and if the BJP concurs with the same, the NCW must approach the Election Commission of India for appropriate action against the BJP under the Representation of People’s Act including its de-registration.
