5 June-2014: Chief Judicial Magistrate Imphal East on Wednesday framed charges against Irom Chanu Sharmila who has been on fast for nearly 14 years demanding repeal of the draconian Armed Forces Special Powers Act, 1958 from the North Eastern state.
The charge order against Sharmila was issued by CJM IE Noutuneshwari Devi on the ground that there is prima facie evidence that the hunger striker had committed the offence of attempting to commit suicide by fasting. The charges were made Under Section 309 of the Indian Penal Code.
Meanwhile, Sharmila and her counsel Advocate Khaidem Mani objected the charges framed allowing the court to further direct to initiate trial of the case by producing prosecution witnesses. The initial trial of the case is fixed on July 7 next, upto which Sharmila was to be detained under judicial custody.
Earlier on Wednesday morning, Sharmila was produced before the court after being escorted from JNIMS security ward.
In the meantime, Mani disclosed that the charges framed against Sharmila by the court was strongly objected and from the side of Sharmila preparation are being made to file revision petition challenging the charge framed against her to either Session Judge or at the High Court of Manipur.
Sharmila was released by the Judicial Magistrate First Class, Imphal East on March 13 on completion of her detaining period under judicial custody. However, her resumption of fast led Porompat Police to arrest her again on charges of attempting suicide and was produced at CJM Imphal East on March 14 last.
